Loop BV (“Loop”, “us”, “we”, or “our”) is a company dedicated to designing and selling products and services that enhance sensory wellbeing, such as earplugs, sleep masks, and related items.

Such as records of messages you exchange with us through the Services, including emails, SMS messages, and messages on WhatsApp where you have opted in to receive marketing messages on that channel. For WhatsApp we also process your mobile telephone number and the name shown on your WhatsApp profile.
(d)   Other Information. Such as when you fill in a form, add information to your account, respond to surveys, post to community forums or other public areas of the Services, participate in promotions or contests, communicate with the Company or other users, or share your experience with us.

2.2    Personal Data We Collect Automatically.  

When you use the Services, we automatically collect personal and other data. This may include:

(a)    Device and Online Usage Information. Such as details about how you’ve used the Services (including if you clicked on links to third-party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, the pages you’ve viewed or engaged with before or after using the Services, the pages or content you view on the Services, and other actions on the Services.
(b)    Transactional Information. Such as information about your transactions on the Services, such as the date, time, and amount charged.
(c)    Geolocation Information. Such as precise or approximate location determined from your IP address, mobile, or other device’s GPS, or other information you share with us, depending on your device settings.

(e)    Protecting Legal Rights and Preventing Misuse. Specifically, we use personal data to protect the Services and our business operations including to detect, investigate, or take action regarding illegal activities, misuse, or suspected fraud; to investigate, enforce, and prevent violations of our policies and terms; and as otherwise necessary to establish, protect, and defend our legal rights. We use third-party platforms to send you marketing and service communications. Our email marketing is delivered through Klaviyo and our SMS messages through Klaviyo, each acting as our processor. Where you have opted in to receive marketing messages on WhatsApp, those messages are delivered through the WhatsApp Business Platform. For users in the European Region that service is provided by WhatsApp Ireland Limited, Merrion Road, Dublin 4, Ireland, acting as our processor under the WhatsApp Business Data Processing Terms, and we also use Klaviyo as our processor to compose, schedule and send these messages and to record your consent.

Our Site is hosted on the Shopify platform. Shopify Inc. acts as our data processor. When you interact with our Site – such as browsing products, making purchases or using features – Shopify collects and processes your personal data to: provide core e-commerce services (checkout, payment processing, order fulfillment), detect and prevent fraud, ensure secure transactions, personalize your experience across Shopify-powered stores, and improve platform-wide services through cross-merchant analytics. We use Shopify’s Enhanced Services and Network Intelligence features. This means Shopify may combine your data with information from your interactions with other Shopify merchants to: improve fraud detection and customer support, optimize advertising across multiple stores, and enhance personalization of your shopping experience. If you use a direct payment gateway, Shopify securely stores your credit card details in compliance with the Payment Card Industry Data Security Standard (PCI-DSS). Your payment information is stored only as long as necessary to complete the transaction, after which it is deleted. Where you have opted in to receive marketing messages from us on WhatsApp, WhatsApp Ireland Limited also processes personal data as a controller in its own right for the operation, security and improvement of the WhatsApp service. 6.    Use of Cookies and Other Online Tracking Technologies.

7.    Your Choices Regarding Your Personal Data. 

We do our best to give you as much choice as possible regarding the amount of data you provide to us, and the control you have over that data.

(a)    Cookies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Site may not work properly. Similarly, your browser settings may allow you to clear your browser web storage.

Opting out of marketing does not affect messages we send you about an order you have placed with us, such as order confirmations and delivery updates, or communications about your account.

We determine the appropriate retention period for personal data on the basis of the amount, nature, and sensitivity of the personal data being processed, the potential risk of harm from unauthorized use or disclosure of the personal data, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).

Research materials, including recordings and transcripts, are retained only for as long as necessary for the research project and related analysis, unless a longer retention period is required by law.

We do not knowingly collect or solicit personal data from anyone under the age of 16.
